each state is different. For prison sentences, judges can usually just choose within a range selected by the leglislature. However, when a court suspends the sentence and grants probation, judges in some states have more leeway and can impose any condition reasonably related to the rehabilitation of the defendant. Theoretically, the defendant can decline those conditions and elect the prison sentence. It is usually impractical to get very creative for several reasons. Most judges see dozens of defendants every day and don't have the ability to fashion clever conditions. Next, the condition must be one that the defendant can accomplish. Telling him to live in a truck would require finding a truck owner willing to give up control of the truck. Next, most defendants lack the resources to do anything special. A with low income who is a parent of a small child, for instance, generally lacks the resources to do much but go to work or go home.
